Levant Industries, Inc., a Georgia corporation, d/b/a Architectural Brass (“Architectural Brass”) warrants, to the original purchaser only, that the product that is the subject of this sale is free from defects in material and workmanship. The duration of this Limited Warranty is one (1) year from the date of delivery. This Limited Warranty is non-transferable. If the purchaser discovers within this period a defect in material or workmanship, it must promptly notify Architectural Brass in writing. In no event shall such notification be received by Architectural Brass later than one (1) year from the date of delivery of the product. Within a reasonable time after such notification, Architectural Brass will correct any defect in material or workmanship, with either new or used replacement parts. All shipping fees shall be prepaid by purchaser and are non-refundable from Architectural Brass. Such repair,  including both parts and labor, is at Architectural Brass’ expense. All warranty service will be performed by Architectural Brass or an authorized dealer designated by Architectural Brass. If Architectural Brass is unable to repair the product after a reasonable number of attempts, Architectural Brass will provide, at its option, one of the following: (a) a replacement product that is the same or comparable to the product purchased, as determined by Architectural Brass, or (b) a full refund of the purchase price. These remedies are the purchaser’s exclusive remedies for breach of warranty.

Architectural Brass does not warrant (a) any product, components or parts not manufactured by Architectural Brass, (b) damage caused by use of the product for purposes other than that for which it is designed, (c) damage caused by lack of proper maintenance, (d) damage caused by disasters such as fire, flood, wind and storms, (e) damage caused by unauthorized attachments or modification, (f) damage caused by unauthorized repair, (g) damage during shipment, or (h) any other abuse or misuse by the purchaser. This Limited Warranty does not cover damage as a result of normal wear and tear from use of the product (for example, scratches, dents, dings, and chipping).

THE FOREGOING WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN THE EVENT THAT THE FOREGOING DISCLAIMER IS NOT APPLICABLE UNDER LAW, THEN ANY IMPLIED WARRANTIES IN CONNECTION WITH THE SALE OF THE PRODUCT SHALL BE LIMITED TO THE

DIRECTION OF THE WARRANTY PERIOD. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

IN NO CASE SHALL ARCHITECTURAL BRASS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES BASED UPON BREACH OF WARRANTY, BREACH OF

CONTRACT, NEGLIGENCE, STRICT TORT, OR ANY OTHER LEGAL THEORY. Such damages include, but are not limited to, loss of profits, loss of savings or revenue, loss of use of the product, cost of capital, cost of any substitute equipment, downtime, the claims of third parties, and injury to persons or property. Some states do not allow the exclusion  or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply.

Any action for breach of warranty must be commenced no later than three (3) months after the end of the warranty period.

Unless modified in writing signed by both parties, this Limited Warranty is understood to  be the complete and exclusive warranty agreement between the parties, superseding all prior agreements, oral or written, and all other communications between the parties relating to the subject matter of this Limited Warranty. No employee of Architectural Brass or any other party is authorized to make any warranty in addition to those made in this Limited Warranty.

This Limited Warranty allocates the risks of product failure between Architectural Brass and the purchaser. This allocation is recognized by both parties and is reflected in the price of the product. The purchaser acknowledges that it has read this Limited Warranty, understands it, and is bound by its terms.
